LEASE & LIABILITY CONTRACT

1 In consideration of the services and products of Easy Bounce Boise, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf, I agrees to release, forever discharge, indemnify & hold harmless Easy Bounce Boise for any injuries, damages or claims that result from my/my party’s negligence including any injuries, claims or damages asserted by my guests, invitees or third parties. I understand and acknowledge that activities related to my rental of inflatable bounce house(s) brings with it both known and unanticipated risks to myself, my guests, my invitees and all others who use the equipment. Those risks include, but are not limited to colliding, falling, slipping, and crashing and could result in injury, illness, disease, emotional distress, death and / or property damage to myself, my guests, my invitees and all other that use the equipment. I understand and acknowledge that such risks are inherent to the activities and simply cannot be eliminated without jeopardizing the essential qualities of the activity.

2 I agree to inspect all equipment and/or related components upon receipt and by using said equipment acknowledge it to be in good working condition. I agree that, outside of routine wear and use, it will be returned in the same condition it was received. I acknowledge that I have received or have access to instructions on how to operate the equipment and/or related components. Equipment includes, but is not limited to bounce houses, generators, electrical extension cords, tarps, stakes.

3 I acknowledges & represent that it have adequate tenant insurance, homeowner's insurance, or other liability insurance to cover any bodily injury or property damage which might occur to myself, my guests, my invitees or any others that use the equipment from the use of the unit being rented. I further agree to accept responsibility for the costs of defense and liability of any such injury or damage.

4 I agree to grant Easy Bounce Boise access to my/the property for the delivery, pick-up or repossession of rented equipment. I agree to operate the rented equipment ONLY where it has been placed/installed/assembled by Easy Bounce Boise. I agree to not displace, move, disassemble, or relocate any rented equipment. I agree not to loan, sublet or otherwise dispose of the rented equipment.

5 In the event that I file a lawsuit against Easy Bounce Boise, I agree to do so solely in the state of Idaho, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

6 Easy Bounce Boise shall not be liable for any damage to my sprinkler system incurred during the setup, removal or use of the inflatable equipment. I am responsible for clearly indicating the location of any underground sprinkler lines or systems prior to installation. Any damage to my sprinkler system resulting from failure to identify these locations shall be my sole responsibility.

7 I agree to always have responsible-party/adult supervision over all activities on/in/with equipment. I agree to follow the directions and safety rules as provided by Easy Bounce Boise.

8 I acknowledge that sufficient time and opportunity were given to me to read and understand this entire contract. I execute it freely, intelligently and without duress of any kind and agrees to be bound by its terms.

ALL BOUNCE HOUSES MUST BE DEFLATED IN THE EVENT OF STRONG WIND AND/OR ADVERSE WEATHER. THIS IS THE RESPONSIBILITY OF THE LESSEE.
